GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 20839 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: <…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4th and 5th respondents in interfering civil disputes and threatening to dispossess the petitioner from the land East to West 25 Meters, North to South 9 meters in Sy No. 140 of Gangapuram Village though the Civil Suits OS No. 268 of 2021 and OS No. 90 of 2021 as illegal, arbitrary and without jurisdiction and violative of Articles 21, 19(1)(g) of the Constitution of India and consequently direct the 4th and 5th respondents not to interfere with the peaceful possession and enjoyment of the petitioner land East to West 25 Meters, North to South 9 meters in Sy No. 140 of Gangapuram Village.…= 2. Heard Sri Kale Vijaya Raju, learned counsel for the petitioner and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioner would submit that the respondent- police are interfering in the civil disputes between the petitioner and 3rd parties relating to civil suits in OS No. 268 of 2021 and OS No. 90 of 2021 and threatening to dispossess the petitioner from his land. 4. Learned Assistant Government Pleader for Home, by way of counter, would submit that two crime have been registered against the petitioner in Cr.No.47 of 2021 under Sections 341, 323 r/w 34 of IPC and Cr.No.317 of 2021 under Section 324 r/w 34 of IPC, on the complaints made by on 4 Ramanjanulu who is the 3rd party to the present petition. He would further submit that investigation is also completed in the above crimes and charge sheets were also filed vide C.C.Nos. 150 of 2021 and 48 of 2022 respectively before the learned Judicial First Class Magistrate, Vyalapadu. Except registration of the above crimes, the police have never interfered in the civil disputes between the parties. 5. Recording the same, this Writ Petition is disposed of. However, the police are directed to follow the due process of law regarding the above crimes registered against the petitioner. No order as to costs.
