Heard Ms. Sofia Mirza, Senior Advocate along with Mr. Ajay Kumrani, learned counsel for the petitioner. Also heard Mr. S.S. Baghel, learned Dy. G.A. for the respondents/ State. 2. The petitioner has filed this petition praying for following Prayer:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire record concerning the case of the petitioner from the possession of the respondent authorities for its kind perusal. 10.2. That this Hon'ble Court may kindly be please to issue a writ in the nature of mandamus commanding the Superintendent of Police Raipur to ensure conduction of further fair investigation of the crime being registered by the Police Station Tikrapara District Raipur under the crime no. 318/2024 lodged on 23.04.2024 for the offence punishable U/s 294, 506, 323, 307, 34 of IPC and crime no. 319/2024 lodged on 23.04.2024 for the offence punishable U/s 302, 294, 506, 323, 34 of IPC in charge sheet submitted on 21.07.2024 before the learned Trial Court by directing the investigating officer to submit supplementary charge sheet U/s 173(8) of Cr.P.C. / U/s 193 of B.N.S.S. 2023 by appointing some other investigating officer in the better interest of justice. 10.3 That this Hon'ble Court may kindly be please to issue a writ of mandamus to the Superintendent of 3 Police Raipur to direct the investigating officer in crime no. 318/2024 and crime no. 319/2024 to comply with the direction of Deputy Inspector General of Police / Senior Superintendent of Police Raipur given to the Thana Incharge Police Station Tikrapara Raipur vide order dated 07.02.2025 in the interest of justice to ensure that fair investigation is conducted in crime no. 318/2024 and crime no. 319/2024, so that fair trial may be conducted in Sessions Trials No. 179/2024 & 180/2024. 10.4 Any other relief or relief(s) which this Hon'ble Court may deem fit or proper in the facts and circumstances of the case.” 3. After arguing for some length, learned counsel for the petitioner seeks permission of this court to withdraw the present petition with liberty to approach appropriate forum. 4. Learned State counsel has no objection. 5. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty. 6.
