The instant petition has been under Section 582 of BNSS, 2023 seeking issuance of directions to respondents No.2 and 3 for taking stern action against the accused who hit the petitioner with an over speeding car coming from wrong side, while he was riding a motorcycle.

Learned counsel for the petitioner submits that the representation was given on 13.03.2025 (Annexure P-2) to the police authorities, however, it had failed to yield any response. It has been submitted that the official respondents were under a legal obligation to pass an appropriate order on his complaint. Learned counsel submits that the petitioner would be satisfied if directions are issued to respondent No.2- Commissioner of Police, Ludhiana to look into the representation dated 13.03.2025 (Annexure P-2) of the petitioner and take appropriate steps in accordance with law.

In the wake of the limited prayer of the petitioner, the instant petition is disposed of and respondent No.2-Commissioner of Police, Ludhiana, is directed to look into the grievance of the petitioner and take appropriate steps, if any required, under the provisions of law. However, if respondent No.2 does not find any substance in the allegations levelled in the representation dated 13.03.2025 (Annexure P-2), then the petitioner shall be duly informed as per the parameters laid down by the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh & Ors. 2013 (4) RCR (Criminal) 979.
