For Petitioner : Mr.P.Tamilavel For Respondents : Mr.C.Jayaprakash, Government Advocate (for R1 to R3) ***** O R D E R The instant writ petition has been filed with a prayer for issuing a Mandamus to direct the first and third respondents to consider the petitioner's representations dated 04.07.2022 and 13.09.2023 to count past service rendered from 31.10.1994 to 20.12.2001 for the purpose of promotion under Career Advancement Scheme. 2. The learned counsel for the petitioner would submit that the petitioner has given the said representations to count his past service rendered from 31.10.1994 to 20.12.2001 for the purpose of promotion under Career Advancement Scheme, and such representations are yet to be 2/6 https://www.mhc.tn.gov.in/judis W.P.No.13393 of 2024 considered by the respondents. In this regard, the learned counsel for the petitioner relied upon the following judgements:- (i) S.Palanivel Vs. The Principal (W.P.No.10049, vide order dated 26.11.2009); (ii) Dr.A.Annadurai Vs. The Government of Tamil Nadu (W.P.No.30292 of 2013, vide order dated 10.07.2017); (iii) Dr.Zubair. M Vs.The Universtiy of Calicut (W.P (C) No.7307 of 2016); (iv) V.Kanagalatha Vs. The Government of Tamil Nadu (W.P.No.22127 of 2008, vide order dated 22.07.2021); (v) Dr.P.Gopinathn Vs. Tamil Nadu Physcial Education and Sports University (W.P.No.6352 of 2021, vide order dated 28.11.2023); and (vi) Dr.P.Manju Pushpa Vs. Bharathiar University (W.P.No.24015 of 2021). 3. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the first to third respondents and perused the materials available on record. 5. In such view of the matter, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representations dated 04.07.2022 and 13.09.2023, and pass orders on its own merits and accordance with law, within a period of six weeks from the date of receipt of a copy of this order. 6. In the result, this Writ Petition is disposed of with the above observations.
