Sudha, For R4 https://www.mhc.tn.gov.in/judis WP No. 48528 of 2025 __________ Page2 of 5 ORDER This petition has been filed seeking a direction to the third respondent to permit the petitioner to attend regular classes as well as the clinical course, and not collect additional fees in the form of event fees, clinical course fees and consequently, to refund the excess fees collected from petitioner. 2. The learned counsel for the third respondent submitted that there is no legal impediment for the petitioner from attending classes and participating in the examinations. 3. The learned counsel for the third respondent further submitted that the petitioner was admitted to the Institution under the Management quota and that only the eligible fees were collected. It is contended that no excess fee has been collected from the petitioner. A detailed counter affidavit has been filed, and the relevant paragraphs are extracted hereunder: “12. It is respectfully submitted that the Petitioner had earlier filed a suit for the same relief before the learned District Munsif Court at Chengalpet in O.S. No. 28 of 2024, which came to be dismissed as not pressed. The said fact was not brought to the knowledge of this Hon'ble Court by the Petitioner. The Petitioner had also sent a notice dated 26.02.2024 to the Respondent College claiming compensation, alleging that she suffered mental agony because she was not allowed to attend classes. Furthermore, the Petitioner https://www.mhc.tn.gov.in/judis WP No. 48528 of 2025 __________ Page3 of 5 preferred a complaint before the State Commission for SC/ST in Complaint No. 66 of 2024, alleging that the Respondent institution had not allowed her to write the examination and had subjected her to caste-based abuse. However, the said complaint was dismissed on 02.04.2024 after the Petitioner admitted during the enquiry that she had filed a false complaint. 13.It is respectfully submitted that even after the Petitioner had filed a false complaint against the institution, the Respondent institution has continued to allow the Petitioner to attend. classes, considering the Petitioner's future and the importance of her academics. The Petitioner falsely submitted before this Hon'ble Court that the Respondent College has not allowed her to attend classes because of pending fees. However, despite the Petitioner having outstanding fee dues to the institution, she is allowed to attend classes and is doing so regularly. For the current VII semester, the Petitioner's attendance is as follows: Semester Subject Attendance Intervals VII Community Health Nursing-II 93 18 [From 03rd October 2025 to 31st March 2026] Nursing Research and 91 19 OBG 93 20 14.It is respectfully submitted that the Respondent institution has not collected any excess fee from the Petitioner. The Petitioner has received four years of tuition and maintenance fees from the Adi Dravidar Welfare Department, totalling Rs. 2,06,000/- Per contra, https://www.mhc.tn.gov.in/judis WP No. 48528 of 2025 __________ Page4 of 5 the Petitioner currently owes the institution Rs. 37,000/- in tuition fee dues and Rs. 60,210/-in other fees for the facilities availed up to VII semester.” 4. Recording the above submissions made by the learned counsel for the third respondent and the counter affidavit, this Writ Petition is disposed of.
