Upon coming up this matter for consideration, the learned counsel for the respondent would submit that a bail application by way of first attempt made by the petitioner herein is pending before the trial court being the court of Principal Sessions Judge, Kathua and in presence of said bail application, the petitioner has approached this Court by filing yet another bail application in his second attempt.

Learned counsel for the petitioner admits of the pendency of the bail application filed prior to the instant bail application before the court below while stating that the same has not been considered and decided by the court below, which compelled the petitioner to approach before this Court through the medium of the instant application.
3. Having regard to the aforesaid position obtaining in the matter, it would be desirable and appropriate to direct the court below to dispose of the bail application filed by the petitioner herein expeditiously without any further delay preferably within a period of 15 days’ time.
4. The instant bail application, in these circumstances, shall stand disposed of.
