1. Petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, this Hon’ble Court may kindly be pleased to quash the impugned order dated 28.11.2024(P/1) passed by the respondent Tehsildar. 10.2 The Hon’ble Court may kindly be pleased to quash the
order dated 07.01.2025(P/2) passed by the respondent Sub Divisional Magistrate. 10.3 The Hon’ble Court may kindly be pleased to quash the
Order dated 15.05.2025(P/3) passed by the respondent Commissioner, Division Sarguja, Ambikapur. 10.4 The Honb’le Court may kindly be pleased to or an alternative direct the respondent state to proceed afresh more particularly as per original or Correct/genuine order dated 26.11.2015 passed by the Board of Revenue and during the pendency the respondent may restrain to take further action. 10.5 Any other relief which this Hon’ble Court deems fit and proper may also kindly be granted to the petitioner, in the interest of justice.”
2. One of the relief of petitioner is to set aside the order dated 15.05.2025 Annexure P-3 passed by Commissioner, Sarguja Division Ambikapur /respondent no. 2 in second appeal filed under Section 44(2) of the Chhattisgarh Land Revenue Code, 1959.
3. Against the order passed by Commissioner, in exercise of powers under Section 44(2) of the Land Revenue Code, 1959, petitioner is having an efficacious remedy under Section 50 of the Land Revenue Code, 1959 to file proceedings before the Board of Revenue and, therefore, I am not inclined to entertain this petition, it is accordingly dismissed, however, petitioner would be at liberty to avail other remedy available under law.
4. Registry is directed to return back certified copy of documents enclosed along with this writ petition, after retaining photocopy of the same. Certified copy as per rules. sd/- (Parth Prateem Sahu) Judge alfiza
