IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No.7264 of 2024
Md. Sagir … Petitioner
Mr. S.R. Das, Advocate
-versus- State of Odisha … Opposite Party Mr. M.K. Mohanty, Addl. PP
CORAM:
JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL) 28.07.2025
11.
I.A No.94 of 2025 & BLAPL No.7264 of 2024
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is an application U/S.483 of BNSS by the petitioner for grant of bail in connection with Plant Site PS Case No.194 of 2022 arising out of ST Case No.93/66 of 2022-23, pending in the Court of learned Adhoc Addl. Dist. & Sessions Judge (FTSC) (POCSO), Rourkela for commission of offences punishable U/Ss.450/ 376(2)(1)/ 323/ 307/ of IPC, on the allegation of sexually exploiting and committing rape upon a old lady. The petitioner further, prays for interim bail in IA No.94 of 2025 on the ground of delay in conclusion of trial.
3. Heard, Mr. Soumya Ranjan Das, learned counsel for the petitioner and Mr. M.K. Mohanty, learned Additional Public Prosecutor in the matter and perused the record.
4. After having considered the rival submissions and taking into consideration the nature and gravity of the offence as alleged against the petitioners vis-a-vis the allegation raised against the petitioner and the supporting materials collected thereof, since the trial has already commenced with examination of two witnesses, this Court does not feel it proper to grant either regular bail or interim bail to the petitioner since the allegation is not only grave, but also diabolical.
5. Hence, the bail application of the petitioner stands rejected. The petitioner may renew his prayer for bail after examination of the victim, but looking at the long custody of the petitioner, he is at liberty to renew his prayer for bail, if the victim is not examined within three months hence.
6. Accordingly, the BLAPL & IA stand disposed of.
7. Issue urgent certified copy of the order as per Rules.
A copy of this
order be immediately communicated to the concerned Court.
