This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 44/2025 registered at Police Station – Civil Lines, Raipur, District – Raipur (C.G.), for the offence punishable under Sections 317(2), 317(4), 317(5),111, 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2. 2 been opened in utkarsh small finance bank branch civil lines Raipur IFSC code UTKS0001400 which are being used to received money from cyber fraud. As per the instruction received from police headquarters, a letter along with the details of the above incident was sent to Civil Lines Police Station, Raipur (CG). Then the First Information Report was registered against 104 bank account holder including the present applicant U/S 317(2), 317(4), 317(5), 111,3(5) (As per order sheet) of B.N.S. the present applicant has been arrested by Police Station Civil Lines, District-Raipur. (C.G.) on 23.01.2025 for the alleged offences punishable U/S 317(2), 317(4), 317(5), 111,3(5) (As per order sheet) of B.N.S.
3. Learned counsel for the applicant would submit that the present applicant is innocent person and has been falsely implicated in this case. He submits that applicant has no connection whatsoever with any person named Rehan, nor is “Rehan” his nickname. Relevant documents, including the applicant’s mark sheets, are annexed herewith as Annexure A/3 in support of his correct name. The applicant has been arrested solely on the basis of the memorandum of co- accused Deepak Chura, and copies of the said memorandum along with the police notices issued to the applicant are annexed herewith as Annexure A/4.
The applicant has no account in Utkarsh Small Finance Bank, Branch – Civil Lines, Raipur (IFSC Code: UTKS0001400), which is alleged to have been used for receiving money from cyber fraud transactions. The charge sheet against the applicant has already been filed on 21.04.2025, and the applicant has been in judicial custody since 23.01.2025, while the conclusion of the trial is likely to take a considerable time. There is no legal material or evidence available on
3 record to constitute any offence against the applicant. The applicant is a permanent resident of the address mentioned in the cause title of this bail application, and there is no likelihood of his absconding or tampering with the evidence or witnesses. The applicant is ready and willing to furnish adequate surety and shall faithfully abide by all the directions and conditions which may be imposed by this Hon’ble Court, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the charge-sheet has already been submitted before the competent Court in the present case. He submits that in compliance with the Hon’ble Court’s order dated 19.09.2025, it is most humbly submitted that the present accused applicant, Rizwan Khan, was arrested on 04.02.2025 by the Range Cyber Police, Raipur, in connection with Crime No. 44/2025, registered at Police Station Civil Lines, Raipur, District Raipur (C.G.), for the offences punishable under Sections 317(2), 317(4), 317(5), 111, and 3(5) of the Bhartiya Nyay Sanhita, 2023, and after completion of investigation, the challan has been filed before the learned Jurisdictional Magistrate, Raipur, on 21.04.2025. During investigation, it was found through coordination with the Cyber Crime Reporting Portal of the Ministry of Home Affairs that 104 bank accounts had been opened at Utkarsh Small Finance Bank, Civil Lines, Raipur, which were being used to launder proceeds of cyber fraud.
On the basis of the information received, one Deepak Chhura, account number 1400020000000829, was arrested, who in his memorandum statement disclosed that one Rehan, mobile number 7869705192, had opened his bank account fraudulently in connivance with bank employees and
4 had kept the entire banking kit with himself, paying him Rs. 2000/- obtained through cyber fraud. Further investigation and CAF details from Airtel Company revealed that the said mobile number belonged to Rizwan Khan s/o Karim Khan, the present applicant, whose memorandum statement was recorded wherein he admitted that he had fraudulently opened the bank account of Deepak Chhura with the help of bank employees and kept the entire banking kit with himself. He further confessed to being acquainted with Kafeel Ahmad, resident of Chistiya Nagar, P.S. Tikarapara, Raipur (Mobile Nos. 9993936253 and 9109155666), to whom he provided the ID and password for online betting and gave him the said bank account for monetary transactions after paying Rs. 2000/- to Deepak Chhura. From the investigation, it clearly emerges that the accused applicant was actively involved in obtaining and using fraudulent bank accounts for illegal transactions in connivance with other accused persons. Considering the gravity of the offence, the organized nature of the cyber fraud, and the likelihood of the applicant tampering with evidence or influencing witnesses if released, the State Counsel respectfully submits that the applicant does not deserve the benefit of bail. 5. Learned State counsel further submits that the bail of other co-accused persons, namely, Anupam Shukla, Praveen Thakur and Om Aarya in MCRC No. 3846 of 2025, MCRC No. 3996 of 2025 and MCRC No. 4011 of 2025 have already been rejected by this Court, vide order dated 22.05.2025, therefore, the bail application of the present applicant is also entitled to be rejected. 6. I have heard learned counsel appearing for the parties and perused the

Considering the facts and circumstances of the case and the fact that present applicant was actively involved in the commission of cyber fraud and further the bail of other co-accused persons, namely, Anupam Shukla, Praveen Thakur and Om Aarya in MCRC No. 3846 of 2025, MCRC No. 3996 of 2025 and MCRC No. 4011 of 2025 have already been rejected by this Court, vide order dated 22.05.2025, therefore, this Court is of the opinion that the present is also not it a fit case to enlarge the applicant on bail. 8. Accordingly, the bail application of the applicant – Rijwan Khan @ Rehan, filed under Section 483 of the BNSS, involved in Crime No. 44/2025 registered at Police Station – Civil Lines, Raipur, District – Raipur (C.G.), for the offence punishable under Sections 317(2), 317(4), 317(5),111, 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
