JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned AGA accepts notice for respondents No.1 and 2. 2. The petitioner is before this Court seeking for the following reliefs; a. "The payment on account of work done dues at Rs.81,53.910.00 along with the payment of interest at 18% from the due date of payment i.e., 25.03.2022 to the date of its realisation as per ANNEXURE F. b. Any other relief that, the Hon'ble Courts deems it fit in the light of the facts and circumstances, including as to the examplary costs." 3. The grievance of the petitioner is that the bills raised by the petitioner for the work carried out have not been paid by the respondents and in that background that the petitioner is before this Court seeking for the positive directions to the respondents to make payment of the amounts. Such positive directions - 3 - HC-KAR NC: 2025:KHC:43406 WP No. 28423 of 2024 cannot be issued by this Court, since the Recovery Proceedings cannot be filed before this Court. 4. Whenever any bills are submitted it is but required for tendering authority to consider the same and make payment of the due amounts or reject the bills within a reasonable period of time. Needless to say, if the bills are rejected reasons have to be accompanied by such order. 5. Neither having been done, I pass the following: ORDER i. The writ petition is disposed of. ii. Respondent No.2 is directed to consider the representation dated 18.09.2024 at Annexure-F and pass necessary orders within a period of four weeks from the date of receipt of copy of this order. iii.
