GP FOR MUNCIPAL ADMN URBAN DEV The Court made the following: 3 Order:- The learned counsel for the petitioner submits that the petitioner is seeking a limited prayer of issuance of a direction to the 2nd respondent to dispose of the Appeal dated 16.06.2021 filed by the petitioner, aggrieved by the action of the Municipality in allowing the BPS online application of Sri P. Raja Hussain. It is submitted that the said Appeal is still pending consideration and requires to be disposed of in accordance with law. 2. The learned Standing Counsel appearing for the 3rd respondent submits that a counter has been filed duly informing that the petitioner and his brother are having certain disputes over the property and both have constructed houses in deviation of the sanctioned plans. It is further submitted that Sri P. Raja Hussain had applied for regularization of the deviations and the respondent authority accepted the BPS application on payment of penalization charges. The Appeal filed by the petitioner could not be considered, as the provision for filing of appeals under the BPS scheme is available only to the applicants, but in the present case the application under the BPS scheme has already been rejected. Finding that the petitioner has no locus to maintain the Appeal, the same was rejected. 3. Recording the same, this Writ Petition is closed. There shall be no order as to costs. 4.
