Tado, learned Additional Public Prosecutor for the State and Mr. C. Modi, learned Legal Aid Counsel for the respondent No.2. This is an application filed under Section 389 of the Code of Criminal Procedure praying for suspension of sentence imposed upon the accused, namely, Babing Haffi on 29.08.2023 by the learned District & Sessions Judge at Bomdila in Sessions Case No.11/2022. I have heard the learned counsel on facts. Mr. G. Tado, learned Additional Public Prosecutor has objected to the interlocutory application. After considering the submissions made by the learned counsel for both the sides and after going through the judgment and available materials, it is hereby directed that the sentence imposed upon the accused, namely, Babing Haffi on 29.08.2023 by the learned District & Sessions Judge at Bomdila in Sessions Case No.11/2022, shall remain stayed till the disposal of the connected appeal. It is also directed that the accused, namely, Babing Haffi shall be released on bail on furnishing a bail bond of Rs.25,000/- with a surety of like amount to the satisfaction of the learned District & Sessions Judge, Bomdila in respect of Sessions Case No.11/2022.
