ORAL ORDER
Petitioner/accused No.1 apprehending his arrest in Cr.No.197/2025 of Avalahally Police Station, Bengaluru City, has preferred this petition seeking anticipatory bail.
2. The learned Sessions Judge has rejected his petition vide
order dated 21.7.2025 in Crl.Misc.No.1292/2025, while granting relief to accused Nos.2 to 4.

In the complaint lodged by one Lavanya, she has alleged that petitioner/accused No.1 and his relatives borrowed a sum of Rs.1,50,000/- to meet the marriage expenses and on 26.5.2025, she was invited to their house for lunch. Further, on 27.5.2025, taking advantage of her illiteracy, accused No.1 took her mobile phone and without her knowledge got information about her bank details and took a loan of Rs.9,34,241/- and transferred to his

account. Thereafter, he deleted the OTP and the bajaj App. Further, as he had requested her to give some loan, she pledged her ornaments and gave a sum of Rs.3 lakhs to him, however, misusing her acquaintance and by hacking her phone, misappropriated a total sum of Rs.12,34,241/-.
4. The offence is alleged to have been committed between 27.5.2025 and 29.5.2025. Complaint is lodged on 16.6.2025. According to the complainant, taking advantage of her illiteracy, petitioner has transferred to his account a sum of Rs.9,34,241/- using her mobile phone. Further allegations are that the complainant gave loan of Rs.3 lakhs to the petitioner by pledging her ornaments but he has cheated her etc.
5. The learned High Court Government Pleader contended that the matter is under investigation and the petitioner is absconding from the registration of the crime and if anticipatory bail is granted, he may not co-operate with the investigation of the case.

6. According to the complainant, without her knowledge, petitioner took her mobile phone and got transferred a sum of Rs.9,34,241/- to his account. Further allegations are that she gave loan of Rs.3 lakhs to the petitioner by pledging her ornaments on an assurance by the accused that he will pay interest but later, cheated her etc. The allegations have to be proved in due course. The offence alleged are not punishable with death or imprisonment for life. Petitioner has no bad antecedents. He has undertaken to co-operate with the investigation of the case.
7. The apprehension of the prosecution can be taken care of by imposing necessary conditions. Hence, the following:
ORDER
1. Petition is allowed.
2. Petitioner/accused No.1 in Crime No.197/2025 registered by Avalahalli Police Station, is ordered to be

released in the event of his arrest, subject to following conditions: a) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties for the likesum. b) He shall furnish his residential address/contact number and shall inform the I.O. in case of change in the address/contact number. c) He shall co-operate with the investigation of the case. d) He shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) He shall be regular in attending the Court proceedings.
