GP FOR REGISTRATION AND STAMPS (AP) 3 HBKM,J W.P.No.22801 of 2020 The Court made the following Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondent Nos.1 to 4. 2. This writ petition was filed questioning the action of the 4th respondent in Registration of Settlement Revocation Deed bearing Document No.1632/2018 dated 22.06.2018 executed by the 5th respondent, thereby unilaterally cancelling the Gift Settlement Deed bearing Document No.1559/2018 dated 18.06.2018 executed by the 5th respondent in favour of the petitioner with respect to the subject land in an extent of Ac.0.33 cents in Sy.No.1476-1C of Koduru Revenue Village and Mandal, YSR Kadapa District in contravention of Rule 26 (k) (i), Section 69 of the Registration Act, 1908. 3. The learned counsel for the petitioner submits that the respondent No.5 executed the Gift Settlement Deed in favour of the petitioner vide document bearing No.1559/2018 dated 18.06.2018 with respect to the subject land and the same was sought to be cancelled unilaterally by Registration of the Settlement Revocation Deed bearing Document No.1632/2018 before the 4th respondent dated 22.06.2018. Aggrieved by the same, this writ petition was filed. 4. The learned counsel for the petitioner submits that this matter is squarely covered by the order of this Court in W.P.No.13939 of 2022 dated 24.10.2024. 4 HBKM,J W.P.No.22801 of 2020 5. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 4th respondent submits that as per the memos issued by the Commissioner and Inspector General of Registration and Stamps, Andhra Pradesh and the Director and Inspector General of Registration and Stamps, Andhra Pradesh, Hyderabad dated 18.07.2008 and 06.06.2016 respectively, the impugned deed of revocation of Gift Settlement Deed dated 22.06.2018 presented by the 5th respondent was entertained by the 4th respondent and the same was registered cancelling the earlier Gift Deed executed by the 5th respondent in favour of the petitioner dated 18.06.2018 with respect to the subject land under Rule 26 (k) (i) and Section 69 of the Registration Act. 6. The learned Assistant Government Pleader also submits that this issue is squarely covered by the order of this Court in W.P.No.13939 of 2022 dated 24.10.2024. 7. As the facts are similar in nature and as the principle was settled by this Court in the above said order, the same benefit is extended in this case also. 8. Accordingly, the impugned action of the 4th respondent in Registering the Settlement Revocation Deed bearing Document No.1632/2018 dated 22.06.2018, executed by the 5th respondent is set aside herewith and the Gift Settlement Deed bearing Document No.1559/2018 dated 18.06.2018 executed by the 5th respondent in favour of the petitioner with respect to the subject land in an extent of Ac.0.33 cents in Sy.No.1476-1C in Koduru 5 HBKM,J W.P.No.22801 of 2020 Revenue Village and Mandal, YSR Kadapa District is restored to its file for all the practical purposes to deal with the subject land in accordance with law by all the parties concerned. 9. Accordingly, this Writ Petition is allowed. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. __________________________ JUSTICE B.
