Heard learned counsel for the appellant(s). None appears for the respondents. Learned counsel for the appellant submits that this Court vide order dated 13.06.2025 dismissed the present Appeal for non-prosecution. He further submits that non appearance of the counsel for appellant insurance company on the date of hearing is neither willful nor wanton, but the reasons explained in the affidavit are filed herewith. Therefore, learned counsel for the appellant submits that he filed this restoration petition praying for restoration of the present appeal by setting aside the dismiss for default order passed by this Court without there being any delay and requested to pass appropriate orders. For the reasons as stated in the accompanying affidavit and considering that the petition itself filed within the period of limitation and submissions made by the learned counsel for the appellant(s), the present application is ordered, subject to payment of costs of Rs.2000/- in favour of the Secretary, High Court Advocates’ Association, within a period of two(2) weeks. Registry is directed to restore the original CMA on the file of this court, upon submission of receipt of payment of costs along with memo to that effect. Registry is further directed to call for LC record and put up the same in the bundle. For hearing, list the matter after four (04) weeks in usual course _________ NV,J BSP
