Neutral Citation No. - 2025:AHC:66017-DB Court No. - 39 Case :- WRIT - C No. - 12935 of 2025 Petitioner :- Prognosis Laboratories Respondent :- Central Vigilance Commission (Cvc) Through Its Secretary Counsel for Petitioner :- Ravi Prakash Chaurasiya Hon'ble Arindam Sinha,J. Hon'ble Avnish Saxena,J.
1. Mr. Ravi Prakash Chaurasiya, learned advocate appears on behalf of petitioner and submits, prayer of his client is for respondent to decide his representation dated 18th November, 2024 registered as complaint no. 80827 of 2024.
2. Respondent is Central Vigilance Commission (C.V.C.). On brief perusal of the petition we find, the complaint was made against Medical Director of Central Hospital, North Central Railway, Nawab Yusuf Road, Prayagraj. It further appears, petitioner's tender was cancelled because of omission to furnish performance guarantee.
3. Petitioner having submitted tender with willingness to execute the work, was faced with cancellation. His remedy was to challenge the cancellation, if petitioner could make out a case of wrong done and illegality in the cancellation. Turning around and complaining against the Medical Director, to thereafter obtain
order of Court on the C.V.C. without making the Medical Director a party is not a procedure that will have the endorsement of Court. Petitioner, if can make out a grievance regarding the cancellation, may find his remedy.
4. The writ petition is disposed of. Registry is directed to communicate copies of the writ petition and this order to respondent.
