Learned counsel for the respondents submits that the instant appeal is not maintainable before this Court, as an order passed under Section 8 of the Arbitration and Conciliation Act, 1996 is appealable before the Court authorized by law to hear appeals from original decrees of the Court passing the order. 02. In the present case, the impugned order has been passed by the learned Munsiff (Sub Registrar), Jammu. Therefore, the order is appealable before the Court of the learned District Judge, Jammu and not before this Court. 03. Faced with the aforesaid objection raised by the respondents, learned counsel for the appellant seeks Serial No. 71 2 AA No. 06/2025 permission of this Court to withdraw this appeal with liberty to file the same before the appropriate forum. 04. The appeal is accordingly dismissed as withdrawn, with leave and liberty as prayed for. It shall be open to the appellant to pray for exclusion of the time spent in prosecuting the present proceedings, while filing the appeal against the impugned order before the appropriate forum, which prayer of the appellant shall be dealt with by the said forum in accordance with the law. 05.
