THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO|809 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A2 and A3, seeking regular bail, in Crime No.196 of 2024 of Anandapuram Police Station, Visakhapatnam Commissionerate. 2. A case has been registered against the petl'tioners herein and others for the offence punishable under Section 20(b)(ii)(C) read with 8`(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). 3. Case of the prosecution, in brief, is that, on 30.08.2024, at about 15.00 hours, at Podugupalem Village, Anandapuram Mandal, Visakhapatnam, on reliable information, the Sub- lnspector of Police, Anandapuram Police Station, along with his staff and mediators, arrested Al to A6 and seized 340 Kgs of Ganja from their possession. Al to A6 confessed about the involvement of other accused in the present crime. The =--EEL EEEiE contraband was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. The quantity of contraband that was seized from the possession of all the accused is 340 Kgs of Ganja. Petitioners herein/A2 and A3 were arrested on 30.08.2024 and since then they are languishing in jail. statutory period of 180 days has expired. But, the police have not completed investigation nor filed charge sheet in this crime so far. lt is also not known aS tO whether the police have filed any application before the J'uriSdiCtiOnaI Court for extension of time for COmPleting the investigation or not. 6. In view of the aforesaid facts and circumstances Of the case, this Court is inclined to grant bail to the petitioners/A2 and A3 on the following conditions. i) The petitioners/A2 and A3 shall be released on bail on their executing personal bonds for Rs.10,000/- (Rupees Ten Thousand only) each wl'th two sureties of the like sum each to the satisfaction of the learned xV Additional Metropolitan Magistrate, Bheemili, Visakhapatnam. ts e=se C:_I, t`-_ ~/ ii) On release, the petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
