Neutral Citation No. - 2025:AHC:63670 Court No. - 6 Case :- WRIT - A No. - 51903 of 2014 Petitioner :- Ram Lakhan Respondent :- State Of U.P. And 4 Ors Counsel for Petitioner :- Awadh Narain Pandey Counsel for Respondent :- P.D. Tripathi Hon'ble Saurabh Shyam Shamshery,J. 1. None present on behalf of petitioner. 2. Rajeshwar Tripathi, learned Chief Standing Counsel and Sri Harsh Vardhan Gupta for respondent nos.2 to 5 are present. 3. Learned Chief Standing Counsel and learned counsel for respondent nos.2 to 5 submitted that grievance of the petitioner in regard to payment of salary towards medical leave has been satisfied since medical leave was sanctioned and due salary was paid. So far as grievance of stoppage of one increment is concerned it was directed vide order dated 30.8.2013 referred in the impugned order, however, in this regard writ petition is silent as well as no prayer is made to challenge the said order. Copy of said order is also not placed on record. 4. Due to such deficiency in pleadings and since one of the prayer of petitioner has already been satisfied and so far as other prayer is concerned since no challenge is made to the order dated 30.8.2013, relief sought cannot be granted. 5. It is very unfair that the above referred prayer of medical leave was satisfied during the pendency of this writ petition, however, neither it was informed to the counsel for petitioner nor any affidavit was filed in this regard. 6. With the aforesaid observation/direction, this writ petition is disposed of. Order Date :- 25.4.2025 SB Digitally signed by :- SANDEEP BHATTACHARYA High Court of Judicature at Allahabad
