THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION No.797 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.335/2024 of IV Town Police Station, Visakhapatnam Commissionerate. 2. A case has been registered against the petitioner and another for the offences under Sections 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution, in brief, is that, on 31.12.2024 at about 6.00 pm, on receipt of credible information regarding illegal possession and transportation of ganja, S.I of Police, along with staff, rushed to car parking, railway station, Visakhapatnam and noticed one person sitting on divider with luggage bags and on seeing police, the said person tried to escape. Then police apprehended him who is A1 and on interrogation he disclosed his identity particulars and police seized 36.475 kgs of ganja from his possession. Police arrested the said person, seized the ganja and got remanded the accused to judicial custody. 4. Heard. Perused the record. 2 5. Learned Assistant Public Prosecutor submits that investigation is at nascent stage and some more witnesses are to be examined. 6. A perusal of the material available on record goes to show that 36.475 kgs of ganja was found in possession of A1 which is a commercial quantity and he was arrested on 31.12.2024. As stated by the learned Assistant Public Prosecutor, the investigation is at nascent stage and some more witnesses are to be examined. Hence, this Court is not inclined to grant bail to the petitioner/A1, at this stage. 7. Accordingly, the Criminal Petition is dismissed. _______________________ K.
