Petitioner has assailed order dated 14.11.2025 of the learned Execution Court, whereby in execution of the partition decree, the subject property was directed to be sold through court auction. Learned counsel for petitioner contends that his grievance is that he is being denied a pre- emptive right to purchase the subject property at market price. 2. After addressing partly, learned counsel for petitioner on instructions seeks permission to withdraw this petition with liberty to participate in the auction proceedings and be granted pre-emptive right to purchase the subject property at the rate quoted by the highest bidder. 3. Accordingly, the petition and the accompanying applications are dismissed as withdrawn with liberty as sought. In case the petitioner is agreeable to purchase the subject property at the same rate as quoted by the highest bidder, the petitioner shall have pre-emptive right.
