ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

“.... a Writ of Mandamus declaring the action of the 3rd and 4th Respondents in (i) failing to register the Petitioners complaint dated 03.11.2025 against 5th and 6th respondent for the offence committed by them (ii) illegally calling the Petitioner for a settlement and recording the same on 09.11.2025, and (iii) thereafter registering Crime No.200 of 2025 on 17.11.2025 against the Petitioners husband as illegal arbitrary and violative of Articles 14 and 21 of the Constitution of India and contrary to Section 154 of the Cr.P.C and consequently direct the 3rd and 4th respondents to register a case on the petitioners complaint dated 03.11.2025 against 5th and 6th respondent for the offence committed by them and conduct a fair, proper and thorough investigation in accordance with law, and further direct the 2nd respondent to initiate appropriate departmental/disciplinary action against the 3rd and 4th respondents for misuse of power, corrupt practices, and violation of statutory and constitutional duties.”
2. Sri Pamarthy Rathnakar, learned counsel for the Petitioner would submit that the Petitioner has been residing in Sai Balaji Apartments, Santhi Nagar, Batwadipalem, Nellore for the past 11 years. Learned counsel would further submit that, about nine years ago, due to the damage caused to her car by the unknown persons, she installed CCTV cameras in the apartment, at her own expense, with the consent of all the residents. It is further submitted that Respondent No.6, who is one of the residents of the said apartment, started objecting the installation of CCTV cameras alleging that the said cameras are affecting his wife’s privacy when she moves in the common corridor. He also threatened to implicate the husband of the Petitioner in false cases. Learned counsel would submit that, inspite of the complaint dated 03.11.2025 given by the Petitioner to the Superintendent of Police, Nellore District, no action has been taken by the Police and in turn the Police are interfering with Petitioner’s safety and security and are insisting her to remove the CCTV cameras. Questioning the action of the Police, the Petitioner filed W.P.No.31924 of 2025 before this Court and the same is pending

consideration. Learned counsel further would submit that, the Police, having influenced by Respondent No.6, without any authority, have been visiting the premises and orally directing her to remove the CCTV cameras.

Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint given by the wife of Respondent No.6 alleging that the husband of the Petitioner herein, by installing CC cameras and observing the movements of the ladies staying in the said apartment and making comments against them, a case in Crime No.200 of 2025 has been registered against him and the same is under investigation. Learned Assistant Government Pleader would further submit that, as a counterblast to the said case, the Petitioner wants to lodge a complaint against Respondent No.6. It is submitted that the Police have not registered the case against Respondent No.6 since the contents of the complaint given by the Petitioner are non-cognizable in nature and advised both parties to settle the issue amicably.
4. Considering the submissions, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedies before appropriate forum in accordance with law. There shall be no order as to costs.
