IN THE HIGH COURT OF ANDHRA PRADESH [3460] FRIDAY, THE TWENTY SIXTH DAY OF SEPTEMBER THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY ...PETITIONER ...RESPONDENT(S)
THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.26886 of 2025 O R D E R:
In the present Writ Petition, the Petitioner is questioning the action of the Respondents in not restoring petitioner’s increment and refixing the pay pursuant to the orders of this Court in W.P.No.24986 of 2014 as illegal and arbitrary. 2. The Petitioner was appointed as conductor on 19.05.1992 and his services were regularized on 19.11.1992. While so, vide orders dated 24.03.2012, the petitioner was imposed punishment of stoppage of two increments with cumulative effect and the same was confirmed by 3rd respondent vide orders dated 17.01.2014. Questioning the same, the petitioner filed W.P.No.24986 of 2014 before this Court and the said writ petition was disposed of on 19.02.2024 and the order of punishment was modified to stoppage of two annual increments without cumulative effect and without back wages. The relevant portion of the order is extracted below:
“Considering the spotless career of the petitioner, the Appellate authority has rightfully reinstated the petitioner. In so far as, imposing of the punishment of deferment of two annual increments with cumulative effect is concerned. There is no reason mentioned why the Appellate Authority was imposing such punishment and at the same time the back- wages have been denied to the petitioner.
Considering the same, the punishment of denial of back-wages to the petitioner is not disturbed however, the punishment imposed by the Appellate Authority dated 24.03.2012 is modified to the extent of reduction of two annual increments for a period of two (02) years without cumulative effect.”
The grievance of the petitioner now is that, inspite of modification of the order of punishment by this Court in W.P.No.24986 of 2014, the respondents
VN,J W.P.No.26886 of 2025
are not refixing the pay. It is also submitted that the petitioner had submitted the representation on 02.12.2024 and the same is pending with respondents corporation. 3. The learned standing counsel for the respondent corporation submits that the representation as well as the order of this Court in W.P.No.24986 of 2014 dated 02.12.2024 shall be taken note and appropriate orders would be passed by the respondents. 4. Considering the same submission, the Writ Petition is disposed of directing the respondents to examine the representation of the petitioner dated 02.12.2024, in the light of the orders passed by this Court W.P.No.24986 of 2014 dated 19.02.2024 within a period of three (03) months and re-fix the pay of the petitioner. (ii) There shall be no order as to costs. As a sequel, miscellaneous applications, if any, shall stand closed. __________________
