JUSTICE SAMEER JAIN Judgment 24/11/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 367/2024 registered at Police Station Atru District Baran for the offence(s) under Sections 109(1), 115(2), 352, 189(2) of BNS, 2023. 2. Learned counsel for the accused-applicant has submitted that the applicant is a senior citizen, aged about 66 years. It is further submitted that son of the applicant, namely Harish, is one of the co-accused in the matter has been released on bail vide order dated 12.11.2025 passed by Co-ordinate Bench of this Court and parity should be maintained. It is also submitted that the injuries sustained by the victim have specifically been attributed to some other person, namely Mahaveer. [2025:RJ-JP:47468] (2 of 2) [CRLMB-15250/2025] 3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application. 4. Having heard the submissions made by learned counsel for the respective parties, and considering the order dated 12.11.2025 passed by Co-ordinate Bench of this Court, the applicant therein has been enlarged on bail under same facts and circumstances and considering that the present case is on the same footing as of co-accused and looking to the overall facts but without commenting upon the merits/demerits of the case, this Court is inclined to enlarge the accused-applicant on bail. 5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Danmal S/o Ramkaran Meena shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
