GP FOR MUNCIPAL ADMN URBAN DEV The Court made the following: 2 ORDER: This Writ Petition is filed by the petitioners, under Article 226 of the Constitution of India seeking Mandamus, for the following relief: “…to issue order direction more particularly one in the nature of Writ of Mandamus declare the in action of the respondents in not taking action on the complaint given by the petitioners on 08/01/2025 in laying road through their land situated in Plot No.9 and 10 situated in R.S.No.484/4, Sivajyothi Nagar, Tirupati within the corporation limits without considering objections raised by the petitioner is illegal, arbitrary and violative of Provisions mentioned in G.O.Ms.No.119 of MA and UD Dt.28/03/2017 and consequently direct the respondents to take action on the complaint made by the petitioner on 08/01/2025 in laying road through their land in plot no.9 and 10 situated in R.S.No.484/4, sivajyothi Nagar, Tirupati…” 2. Heard learned counsel for the petitioners and learned Standing Counsel for Municipal Corporation appeared for the respondents. 3. When the matter is taken up for hearing, learned counsel for the petitioners submits that the issue involved in this writ petition is squarely covered by the order, dated 12.08.2024, passed by this Court in W.P.No.17671 of 2024. 4. Learned Standing Counsel for Municipal Corporation does not refute the submission made by the learned counsel for the petitioners. 3 5. The relevant portion of the order, dated 12.08.2024 in W.P.No.17671 of 2024 reads as follows: “7. Recording the submission made by the learned counsel for the respondents, instead of going into the merits of the case, the writ petition is disposed of by directing respondent No.2-The Commissioner, Tirupati Municipal Corporation to pass appropriate orders on the representation dated 30.07.2024 submitted by the petitioners, within a period of four (4) weeks from the date of receipt of a copy of this order in accordance with law. However, the respondent authorities are directed not to interfere with the petitioners’ property i.e. Plot Nos.9 and 10 situated in S.No.484/4, Sivajyothi Nagar, Tirupati without following due process of law. There shall be no order as to costs.” 6. Having regard to the facts and circumstances, this Writ Petition is disposed of, in terms of the order passed in W.P.No.17671 of 2024, dated 12.08.2024. No order as to costs. 7. Registry is directed to attach the copy of the order, dated 12.08.2024 passed by this Court in W.P.No.17671 of 2024 to this order.
