Order on Board 28.10.2025
1. This is an o0ce reference.
2. This Court, vide order dated 01.12.2023 passed in MCRC No. 8342 of 2023, while allowing the bail to the applicant, namely, Hira Patel, had expressed its trust that the trial Court would make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certi=ed copy of the
order, if there was no legal impediment.
3. Earlier on two occasions also this Court had granted extension of time for compliance of the order dated 01.12.2023.
4. The learned Special Judge (NDPS Act), Raipur District-Raipur KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 (C.G.) vide his request letter dated 06.10.2025 has requested for grant of six months additional time for concluding the trial.
5. It transpires from perusal of the PUD that in the present case, the Investigating O0cer has retired and is reported to be residing in District Kondagaon. Despite the continuous issuance of arrest warrants through the Superintendent of Police / Inspector General of Police as a last opportunity to secure the presence of the said witness, his attendance could not be ensured, although persistent eCorts are being made in this regard. Even after several warrants were issued through the Superintendent of Police and Inspector General of Police directing the Investigating O0cer to appear, the presence of witnesses could only be secured after considerable delay. It is therefore humbly prayed that an additional period of six months may kindly be granted so that the prosecution witnesses can be examined, the statement of the accused recorded, the defence evidence (if any) taken, =nal arguments heard, and the judgment pronounced.
6. The request made by the learned trial Court, is allowed, however, instead of granting six months, this Court deems it appropriate to grant further 04 months time for concluding the trial from today.
7. Accordingly, this CRMP stands disposed o5 with the aforesaid direction.
8. Registry is directed to send a certi=ed copy of this order to the trial Court concerned for necessary information and compliance. Sd/- (Ramesh Sinha)
