A JAYANTHI 4 The Court made the following: ORDER: This Contempt Case is filed for willful violation of the orders passed by this Court in W.P. No.4279 of 2025 on 07.02.2025, wherein this Court passed the following order: <In view of the same, instead of keeping the writ petition pending, this Court feels it appropriate to dispose of the writ petition by directing the respondent authorities to proceed further in pursuance of the Confirmation Order dated 12.12.2024 as against the 6th respondent, by duly conducting an enquiry in accordance with law. The respondent authorities are also directed to pass appropriate orders on the representation made by the petitioner on 16.12.2024, within a period of two (2) weeks from the date of receipt of a copy of this order.= 2. The respondent Nos.5 and 3 have filed detailed counters. The respondent No.3, in his counter, stated that in pursuance of the interim orders passed by this Court on 20.02.2025, a charge sheet was filed against the unofficial respondents, and the Office has also initiated the following action on the said construction as under: a) An occupancy certificate has not been issued by this office for the said construction till date. b) The Revenue Officer and Superintending Engineer of this office were directed not to sanction any water connection, extend municipal facilities, or process any further transactions related to assessments of the said construction until disposal of C.C.190 of 2025 by the Hon’ble High Court. c) A communication letter was addressed to the Deputy Executive Engineer, Operation Sub-Division Town-1, APSPDCL, Ananthapuramu, vide Roc. No. 733/2025/G2 dated 24.07.2025, seeking an explanation on how the electricity connection was released to the said premises without obtaining prior confirmation of Occupancy Status from this office. 5 d) An endorsement vide Roc. No. 733/2025/G2 dated 01.08.2025 was issued to Smt. P.V. Ademma, directing stoppage of all further construction activities at the subject premises, as the matter is sub-judice before the Hon’ble High Court. 3. The 5th respondent has also filed a counter-affidavit, duly stating that in pursuance of the orders passed by this Court, this office has initiated action on the said construction, which stands as Cellar + G + 2 upper floors building in deviation to the sanctioned plan vide BA No. 1001/0080/B/ATP/CUTROA/2023 dated 08.06.2023, with respect to setbacks, by filing a charge sheet in the learned Additional Judicial First Class Magistrate, Ananthapuramu, vide C.C. No.190 of 2025, which is under prosecution. 4. The said facts would establish that, in pursuance of the orders passed by this Court, the respondent Nos.3 and 5 have initiated action by filing a charge sheet vide C.C.No.190 of 2025, on the file of the Additional Judicial First Class Magistrate, Ananthapuramu, which is under prosecution. Further, no occupancy certificate has been issued for the said construction till date. The Revenue Officer and Superintending Engineer have been directed not to sanction any water connection, extend municipal facilities, or process any further transactions relating to the said construction until disposal of Calendar Case No.190 of 2025 before the Court below. An endorsement was also issued vide Roc. No. 733/2025/G2 dated 24.07.2025 in favour of the unofficial respondent, directing stoppage of all further construction activities at the said 6 premises, as the matter is pending before the learned Additional Judicial First Class Magistrate, Ananthapuramu. 5. In view of the action initiated by the respondent Nos.3 and 5, this Court is of the opinion that no further contempt lies. 6. Accordingly, this Contempt Case is closed. There shall be no order as to costs.
