Petitioner has filed this criminal miscellaneous petition with a prayer to modify the order dated 27.02.2024 passed in MCRC No.1164 of 2024 granting bail to applicant/petitioner. He submits that condition imposed Digitally signed by PRAVEEN KUMAR SINHA Date: 2025.11.14 14:28:52 +0530 2 / 3 for release of applicant/petitioner on bail i.e. “on furnishing personal bond in the sum of Rs.25,000/- with one surety in the like sum” may be modified and direction be issued to release the applicant/petitioner on his furnishing personal bond in sum of Rs.25,000/- only. 2. Learned counsel for the petitioner/applicant submits that petitioner is in jail since 22.07.2022 and he is not in a position to furnish surety as directed by this Court in the order dated 27.02.2024 granting him bail and therefore this Court may kindly modify the earlier order and direct release of petitioner/applicant on his furnishing personal bond only. He also contended that multiple crime was registered against the petitioner/applicant and in one case, coordinate Bench of this Court has enlarged the petitioner/applicant on bail vide order dated 10.04.2024 passed in MCRC No.2094 of 2024. In that case also, petitioner/applicant had submitted similar application (CRMP No.2763 of 2025) which was allowed and it was directed that petitioner be released on bail on his furnishing personal bond. 3. Learned counsel for the State submits that in view of submission made by learned counsel for the petitioner that similar prayer as made in this petition has been considered and allowed in another petition filed by same petitioner, she is having no objection. 4. On due consideration of submissions made by learned counsel for the petitioner, condition imposed for release of petitioner/applicant vide order dated 27.02.2024 passed in MCRC No.1164 of 2024 that “applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to satisfaction of trial Court concerned” is modified and it is directed that “applicant 3 / 3 shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- to the satisfaction of trial Court concerned”. Other conditions imposed upon the petitioner/applicant in the bail order dated 27.02.2024 shall remain intact. 5. Criminal Miscellaneous Petition is accordingly allowed.
