The instant petition has been filed for the following relief:- "Issue a writ, order or direction in the nature of mandamus directing the respondent no.2, Consolidation Officer, Dumariyaganj, District Siddharth Nagar to decide the recall application dated 15.1.2011 filed by respondent no.3 in case No. 1812 to 1822/207 to 2017 restoration, Jamal Ahmad Vs. Nazir Ahmad, under Section 9A (2) of the U.P.C.H. Act relating to Village Mahua Khurd, Tappa Hallaur, Pargana Rasoolpur, Tehsil Dumariyaganj, District Siddharth Nagar within stipulated period, specified by this Hon'ble Court." 3. Counsel for the petitioner submitted that time barred restoration/ recall application filed by respondent no.3 is pending before respondent no.2, Consolidation Officer, Dumariyaganj, District Siddharth Nagar. He submitted that appropriate direction be issued for expeditious disposal of time barred restoration application dated 15.1.2011 filed by respondent no.3 within time bound period. 4. I have considered the arguments advanced by learned counsel for the parties and perused the records. 5. There is no dispute about the fact that restoration/ recall application dated 15.1.2011 filed by respondent no.3 is time bound. 6.
