Shekhawat, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 04/12/2025 1. This second bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.241/2024 registered at Police Station Sarwar, District Kekri (Raj.) for offence punishable under Sections 305(a) & 331(8) of BNS, 2023. After completion of investigation, police filed charge-sheet in this matter for the offences punishable under Sections 305(a), 103(1), 331(4), 61(2)(a) & 3(5) of BNS, 2023 & Section 3(2)(v) of SC/ST Act. 2. The first bail application filed on behalf of the petitioner was dismissed as withdrawn by this Court vide order dated 31.01.2025. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Counsel submits that [2025:RJ-JP:49247] (2 of 3) [CRLMB-5935/2025] none of the prosecution witnesses has supported the prosecution case and they have been declared hostile. It is submitted that the entire case is based on circumstantial evidence as there is no eye- witness of the incident. It is submitted that one of the co-accused person, who was present at the time of the alleged incident, has been granted benefit of bail by the co-ordinate Bench of this court. Trial of the case will take considerable time in its conclusion. It is submitted that at the time of alleged incident, petitioner was aged about 22 years of age and he is in custody since 26.07.2024. Further custody of the petitioner would not serve any fruitful purpose. 4. Learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner. He submits that there is serious allegation against the petitioner of hiring two co-accused persons for committing robbery in the house of the complainant and during the robbery, his grandmother was murdered by the co-accused persons. In the CCTV footage, collected by the Investigating Agency during the course of investigation, petitioner and co- accused persons are clearly visible. 5. I have heard the contentions. 6. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced at bar, especially considering the material available on record in the form of charge-sheet, so also considering the role of the petitioner, who is involved in the murder of his own grandmother as well as looking to the nature and gravity of offence, this Court is not inclined to enlarge the petitioner on bail. [2025:RJ-JP:49247] (3 of 3) [CRLMB-5935/2025] 7. Accordingly, this second bail application stands dismissed. 8. The observations made hereinabove are only for decision of the bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J GAUTAM JAIN /6
