Heard the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in trying to interfere with the petitioners’ peaceful possession and enjoyment of the property covered in an extent of Ac.0.87 Cents in S.No.264/1P, Ac.1.00 cents in S.No.264/1P, Ac.0.70 cents in S.No.249/9P and Ac.0.77 cents in S.No.249/11P through title deed and pass books in the name of the petitioners at Gandhavaram Village, Padmanabham Mandal, Visakhapatnam district including eviction of the petitioners under the guise of the government Scheme <Navaratnalu Pedalandariki lllu= by force, coercion, influence Etc., even without issuance of any notice, without following the due process of Law. 3. On the other hand, the learned Assistant Government Pleader appearing for the respondents submits that the respondent authorities concerned will follow the due procedure with respect to the subject land. 4. In view of the above said facts and circumstances, if the subject land is not utilized and if not already utilized by now for the above said public purpose of the welfare scheme, the respondent Nos.2 to 5 are directed to deal with the subject land in an extent of Ac.0.87 Cents in S.No.264/1P, Ac.1.00 cents in S.No.264/1P, Ac.0.70 cents in S.No.249/9P and Ac.0.77 cents in S.No.249/11P, strictly in accordance with law and if the petitioners are 4 HBKM,J W.P.No.5444 of 2020 otherwise found to be in possession of the same, they shall be dealt with strictly in accordance with law, giving due opportunity of hearing to all the parties concerned, including the petitioners, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
