This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Complaint Case No.13 of 2024, under Section 420 IPC, Police Station Phoolpur, District Azamgarh pending in the Court of Additional Chief Judicial Magistrate MP/MLA, Civil Judge (SD), Azamgarh expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted that though summoning order against the accused opposite party no.2 was passed but the she has not appeared. In this matter it is evident from the perusal of the record that summon was sent against the opposite party no.2 only on 18.2.2025 i.e before three months only. Hence, the Court finds no proper and genuine ground to issue any direction to the trial court for expeditious disposal of the aforesaid case. 4. The application is dismissed.
