Petitioners Suraj Kumar, Des Singh and Kaushalaya Bai have filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking grant of anticipatory bail in FIR No. 105 dated 31.05.2022 under Section 306, 34 of IPC (Section 304-B IPC charge framed by learned trial Court later on) registered at Police Station Sadar Fazilka, District Fazilka, Punjab (Annexure P-1) or in alternative to accept bail bonds on addition of offence under Section 302 of IPC in charge-sheet in pursuant to order dated 03.04.2025 passed by learned Additional Sessions Judge, Fast Track Special Court (POCSO), Fazilka (Annexure P-13).

As per previous order dated 28.04.2025, present petitioners were granted interim bail as under :-

“xxx xxx xxx I have considered the aforesaid factual position. As referred above, the petitioners were granted bail by this Court vide
order dated 07.02.2023 (Annexure P-3) and order dated 04.10.2023 (Annexure P-4). There is nothing on record to show that petitioners misused the concession of bail granted in their favour. It is also matter of record that at the fag end of trial, application was filed for addition of offence under Section 302 IPC which has been allowed by the trial Court vide order dated 03.04.2025 (Annexure P-13). Petitioners are ready to face the trial and abide by the terms of bail order. Therefore, the petitioners are directed to appear before the trial Court on or before the date fixed and be released on interim bail to the satisfaction of trial Court. xxx xxx xxx”

Status report is filed by respondent-State, which is taken on record. Learned counsel representing petitioners have annexed order dated 01.05.2025 passed by learned Additional Sessions Judge, Fazilka, according to which present petitioners have been released on interim bail on furnishing bail bonds and surety bonds to the satisfaction of trial Court. Petitioners have duly complied with aforesaid order.

In view of this, interim bail already granted in favour of petitioners stands confirmed and petition filed by them is, accordingly,
disposed of.

Pending miscellaneous application, if any, shall also stands
disposed of accordingly.
