The Court made the following ORDER: 1. The Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is filed on behalf of the petitioner/accused No.1 seeking regular bail in Crime No.399 of 2024 of Arundalpet Police Station, Guntur District. •|_ E= r/ ~/, /, ./ . 2. A case has been regI'Stered against the petitioner and others for the offences punishable under sections 323, 376(2)(n), 506, 509, 420 read with 34 IPC. 3. case of the prosecutI-On is that the de-facto complaI-nant lodged a report on 20.12.2024 statl'ng that the accused No.1, under the pretext of love, was harassing her. The de-facto complainant got acquaintance wI'th the accused through her common college friends on Facebook and lnstagram. He used to harass her by sending messages to accept hI-S love. Though she blocked him, he started calling her and messaging her from other accounts and was demanding money. He further threatened her that he would post her photos on social media if she didn't love him. Further parents of the accused also tried to convince her. Accused No.1 took de-facto complainant to Lotus Lodge and forcibly had sex with her and further on false promise, he tied yellow thread in her neck. 4. Heard both sides. 5. A perusal of the material on record goes to show that the petitioner and the de-facto complainant came to know about each other through common friends. Thereafter, both of them were exchanging messages Ion Facebook and also exchanged thel'r phone numbers. Thereafter, the accused and the de-facto complainant I (``\ iS \+ \- were talking over phone. On a reading of the remand report, it shows that the parents of the accused No.1 came to know about their love through accused No.1. Subsequently, they did not tell any objection to perform their marriage. Police, during the course Of investigation, examined the staff of the Lotus Lodge. They categorically stated that the accused and the de-facto complainant used to visit their loge and stay there for two to four days. lt shows that the accused and the de-facto complainant were known to each other for a period of two years. lt is admitted that the petitioner and the de-facto complainant were vis'lting the Lotus Lodge and staying there for two to three days. The petitioner was arrested On 21.01.2025 and since then, he iS languishing in jail. 6. The learned Assistant Public Prosecutor submits that major part of the investigation |ls completed except filing of the charge- sheet- 7. ln view Of the aforesaid facts and Circumstances, this Court is inclined to grant bail to the petitioner/accused No. 1 herein, on the following conditions. (i) The petitioner/accused No.1 herein shall be released on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the i '>f --_-:.3i5i5~-+, .<=, -¥._-'=,- satisfaction of the learned V Additional Judicial Magistrate First Class, Guntur. (ii) On release, the petitioner/accused No. 1 shall appear before the station House Officer concerned once in a Week i.e. on every sunday between 10.00 a.m. and 05.OO p.m., till filing of the charge-sheet. 8.
