C SUBODH The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: 2 “.... a Writ of Mandamus declaring the action of the Respondents No.3, in interfering in a civil dispute and threatening the petitioners to handover the land an extent of Ac.7.73 cents in Sy.No.2-39, of Koduru Kandriga Village, T.P. Guduru Mandal, SPSR Nellore District, to the 4th respondent and giving threats through the son of the petitioners, though there is no any direction to handover the said land to the 4th respondent, while pending the appeal in A.S. No. 97/2022, on the file of the court of the VIII Addl. District Judge, Nellore, against the decree and Judgement in O.S. No. 630/2012, on the file of the court of the 1st Addl. Senior Civil Judge, Nellore, is as arbitrary, illegal, unjust, unconstitutional and against the principles of natural justice, consequently directing the Respondents not to interfere in civil dispute.” 2. Sri G.Jagadeeswar, learned counsel for the Petitioners would submit that the Police are interfering with the civil disputes between the Petitioners and the unofficial Respondent. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that, in view of the interim order dated 10.10.2022 in I.A.No.1 of 2022 the Police are not interfering with the civil disputes between the parties. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed not to interfere in the civil disputes between the parties, except under due process of law. There shall be no order as to costs.
