Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 05.02.2025 [1] Heard Mr. P. Stephen, learned counsel for the petitioner and Mr. S. Niranjan, learned G.A. for the State respondent. [2] In terms of the earlier order dated 29.01.2025, the petitioner filed additional affidavit stating that Mr. Khangkhanlung Rongmei and Mr. Akhan Rongmei are the same person and affidavit is taken on record. [3] It is the case of the petitioner that a plot measuring 25 x 60 feet was allotted by the Deputy Commissioner, Tamenglong to the petitioner vide order dated 22.05.2009 and declaration deed was also executed. It is stated that the petitioner is staying in the said plot since then. However, by the impugned notice for eviction dated 24.01.2025 issued by the Sub-Divisional Officer, Tamenglong, issued to the petitioner, he was informed to vacate from the staff quarters of Health Department, Tamenglong located below CMO Office Complex, Tamenglong. [4] Mr. P. Stephen, learned counsel for the petitioner, submits that the petitioner is staying in the land allotted by the Deputy Commissioner, Tamenglong and he never stayed in any quarter of the Tamenglong and also states that in the impugned notification of vacation, house number, etc. of the premises allegedly under occupation of the petitioner is not mentioned. [5] Mr. S. Niranjan, learned G.A., submits that the State respondent may be permitted to issue a fresh notice in lieu of the impugned notification dated 24.01.2025 for vacation of the illegal occupation from the Government quarter as per rule. [6] Recording the submissions made at the bar and on perusal of the materials on record, writ petition is allowed. The impugned notification of vacation dated 24.01.2025 issued by the Sub- Divisional Officer, Tamenglong to the petitioner is set aside with liberty to the respondent to take appropriate step as per rule. [7] With this observation, writ petition is disposed of. MC(WP(C) No. 64 of 2025 is disposed of accordingly. [8] Furnish a copy of this order to the learned counsel appearing for the parties.
