This appeal had been preferred by appellant under Section 378(3) of Cr.P.C. against judgment and order dated 23.01.1979 passed by learned Additional Chief Judicial Magistrate, Agra in Criminal Case No.4251 of 1977 acquitting the respondent, namely, Bhawani Ram. 3. Vide earlier order dated 20.08.2025, Chief Judicial Magistrate, Agra was directed to report regarding status of sole respondent. 4. In compliance of the said order, Chief Judicial Magistrate, Agra vide its report dated 29.08.2025, has apprised the Court that the sole respondent had expired about 18 years ago. 5. In view of the report of Chief Judicial Magistrate, Agra dated 29.08.2025, the appeal is liable to be dismissed as abated since the sole respondent had already been expired. 6.
