The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No.78/2024 registered at Police Station, Special Police Station (SOG), District ATS and SOG for the offences under Sections 419, 420, 467, 468, 471, 120-B of IPC and Sections 3, 4, 6, 7, 10 of Rajasthan Public Examination (Use of Unfair Means) Act, 2022. 2. Learned counsel for the accused-applicant has submitted that the applicant is sole bread earner of the family, aged about 30 years. It is further submitted that name of the applicant is not mentioned in the FIR. It is also submitted that no specific allegation regarding the active involvement in the alleged offence [2025:RJ-JP:47374] (2 of 3) [CRLMB-14512/2025] has been levelled against the applicant during the course of investigation. It is further submitted that there is no tangible evidence on record to establish the fact that the applicant has played any instrumental role in procuring or arranging fabricated and forged mark-sheet or degree from the concerned university. Moreover, it is submitted that the applicant is in custody ever since 17.10.2025 and the trial will take long time to conclude. 3. Per contra, learned Public Prosecutor, along with the concerned Investigating Officer, who is present in the Court, have strongly opposed the instant bail application. It is submitted that there are two criminal antecedents of similar nature registered against the applicant, in which the applicant has committed organised fraud in the public employment recruitment processes and the applicant has played an instrumental role in arranging dummy candidates, forged degrees, and other such malpractices. It is further submitted that not only the applicant but several members of his family including the sister of applicant, the sister- in-law of applicant are alleged to have appeared in the PTI examination themselves and played a significant role in facilitating the use of unfair means in the public examination, and have also been arrested in connection with the said offence. Moreover, it is submitted that tampering with public employment recruitment processes constitutes a serious white-collar crime of a heinous and grave nature, as it directly undermines the merit of genuine candidates and adversely affects the integrity of the entire selection process. It is further submitted that a strong prima facie on the aforesaid grounds case is made out against the applicant. [2025:RJ-JP:47374] (3 of 3) [CRLMB-14512/2025] 4. Having heard the arguments advanced by learned counsel for the parties and considering the fact that there are criminal antecedents of similar nature registered against the applicant; that a strong prima facie case of tampering the process of public examination has been made out against the applicant; that the applicant, along with the family and relatives, has played an active role in facilitating the use of unfair means in the public examination and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is not inclined to allow the present bail application. 5. Accordingly, the present bail application is dismissed. (SAMEER JAIN),J CHANDAN /127
