ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in taking steps for dispossession of the petitioner with respect to land in S. No. 60-1 admeasuring Ac.0.71 cents in Thimayapalem Village, Chejarla Mandal, SPSR Nellore District before the expiry of lease period in L.Dis.No. 720/85 dated 12.05.1985 of the 4^ respondent as illegal, arbitrary, unjustified, Articles 14, 19 and 300-A of the Constitution of India, unreasonable and conseguently direct the respondents to not to dispossess the petitioner and not to interfere with the subject land without following due process of law till completion of lease period in L.Dis.No. 720/85 dated 12.05.1985 of the 4^ respondent and pass such other order. ”

learned counsel for the petitioner and the learned Government Pleader for the respondents. th

Learned counsel for the petitioner submits that the 4 respondent granted lease in respect of the government poramboke land admeasuring to an extent of Ac.0.71 cents in Sy.No.60-1, Thimayapalem Village, Chejarla Mandal, SPSR Nellore District in favour of the petitioner for a period of fifty years vide L.Dis.No.720/8 dated 12.05.1985. After the death of the petitioner’s husband, the petitioner has been in possession and enjoyment of the subject
3 lease hold property. The lease period is in force till
12.05.2035. \ While the lease period is in subsistence, the respondents are trying \ to dispossess the petitioner from the subject property.
4. Learned Assistant Government Pleader for Revenue submits that, if the lease period of the petitioner is still in force and if she entitled any right being legal heir after the death of original lease holder, the respondents would follow due process of law.

Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents and on perusal of the material placed on record, without going into the merits of the case, this Court deems it appropriate to dispose of the Writ Petition directing the respondents not to interfere and not to dispossess the petitioner from the subject property without determining the rights of the petitioner being legal heir of the original lease holder, without following due process of law.
6. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel miscellaneous application, pending, if any, shall also stand closed.
