JUDGMENT Raja Vijayaraghavan V., J. This appeal is preferred challenging the order dated 13.02.2025 in Crl.MP No.25/2025 in S.C.No.2/2023/NIA on the files of the Special Court for Trial of NIA Cases, Ernakulam.
2. By the said order, the application filed by the appellants herein, who are accused Nos.17 and 22, seeking interim bail for a period of seven days from 16.04.2025 to 22.04.2025 to attend the marriage function of their sister was rejected.
3. Today, when the matter was taken up for consideration, the
learned counsel appearing for the appellants submitted that the limited request at this juncture is only for escort parole for a day on 19.04.2025.
4. Sri. Sasthamangalam S. Ajithkumar, the learned Senior counsel appearing for the NIA submitted that the respondents have no objection in considering the said request.
5. We have considered the submissions advanced and have gone through the records.
6. In view of the humane stand taken by the respondents, and
CRL.A NO. 531 OF 2025 4 2025:KER:28571 taking note of the reason for which escort parole is sought for, we are of the view that the request of the appellant for escort parole to attend the marriage function of their sister on 19.04.2025 can be granted. Resultantly, this appeal is disposed of directing the Superintendent of the Jail wherein the appellants are undergoing pre-trial detention to take necessary steps to grant escort parole to the appellants from 10.00 a.m. to 5.00 p.m. on 19.04.2025 to attend the marriage function scheduled to be held at Gayathri Auditorium, Olavakkode, Palakkad District.
