The petitioner claims that a residential plot was allotted in his favour by Greater Noida Authority on 18.9.2013, followed by an agreement to lease dated 31.1.2014. It is not disputed that under the allotment letter, apart from allotment money, the remaining amount was to be deposited in fourteen installments. The Development Authority has intimated the petitioner under the Right to Information Act, 2005 that a sum of Rs. 4,26,870/- is payable as lease deed delay penalty and Rs. 1,83,397.55 as the balance amount towards the remaining premium. The petitioner is stated to have submitted an application for waiver of late fee charges. The said application has still not been considered. The petitioner has therefore prayed for a writ of mandamus directing the respondent-Authority to refrain from realizing the late fee charges and the balance amount and execute lease deed and handover possession of the allotted premises. 2. Ms. Anjali Upadhya, learned counsel for the respondent- Development Authority, submits that in case any representation is made by the petitioner against imposition of lease deed delay penalty and the remaining dues as intimated to him vide reply dated 9.8.2024 in response to his application dated 20.6.2024, the Authority will decide the same. 3. Accordingly, the petition is disposed of with liberty to the petitioner to file exhaustive representation within two weeks from today, along with true attested copy of the instant order, and in which event, the same will be decided by the respondent-Authority by a speaking order within next six weeks, after affording opportunity of hearing to the petitioner.
