Accordingly, both these bail applications are being disposed of a common order. Heard the parties. Petitioners have been made accused in connection with Adityapur P.S. Case No. 438 of 2024, for the offences registered under Sections 17(b)/21(b)/21(a) of the N.D.P.S. Act, pending in the Court of learned Principal District and Sessions Judge, Saraikella – Kharsawan. On 06.12.2024 at about 2:35 P.M., Adityapur police apprehended the petitioners along with co-accused persons and on search, 31.79 grams of brown sugar were recovered from the possession of the petitioners. It was submitted that quantum of seized brown sugar comes within the purview of the intermediary quantity. Mr. Bhola Nath Ojha, learned Spl.P.P. submitted that petitioner Rahima Khatoon @ Motki @ Rahima is accused in as many as four cases on similar nature while petitioner Nazmun Nisha @ Najmun Nisha @ Tajmun is accused in another case on similar nature. Considering the criminal antecedent of the petitioners, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for bail stands rejected. (Ambuj Nath, J.) Jay/-
