1. The petitioners have filed this bail application under Section 483 of BNSS in FIR No.815/2024 registered at Police Station Kotwali Baran, District Baran for offence under Sections 103(1), 140(3), 189(2) of BNS.
2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that seventeen witnesses are on record and out of which only nine have been examined. Out of list of seventeen witnesses only two witnesses Aashish Mehta PW-4 and Khushi Kanwar PW-5
[2025:RJ-JP:49066] (2 of 2) [CRLMB-4536/2025] have been designated as eye-witnesses and both the witnesses have not reiterated their stand and have turned hostile, except this, there are no other eye-witnesses from PW-1 to PW-9. None of the other witnesses have thrown any positive light on the prosecution story. The trial of the case will take considerable time and no further custodial interrogation is required, therefore, in view of the absence of any incriminating statement, the bail application of the petitioners may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Deep Singh @ Deepanshu and Pradeep Singh @ Tolu S/o Shri Vikram Singh be released on bail provided they furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
