THE HON’BLE SRI JUSTICE BATTU DEVANAND WRIT PETITION No.10122 of 2017 ORDER: 1. This Writ Petition has been filed against the inaction of the respondent No.3 in registering the Crime against the respondent Nos.4 to 15 as orders passed in CC.SR.No.7074/2016 on the file of the Judicial First Class Magistrate at Razole, East Godavari District, dated 26.12.2016, nor conducting proper investigation by the Respondent No.3 on the complaint lodged by the petitioner on 20.10.2016, as illegal, arbitrary and violation of principles of natural justice. 2. During the course of hearing today, learned Assistant Government Pleader appearing for the respondent Nos.1 to 3, as per instructions, dated 28.03.2017, would submit that in view of the orders of the Judicial First Class Magistrate Court, Razole, East Godavari District, a case was registered in Crime No.53/2017, dated 22.03.2017, under Section 403, 425, 434, 447, 506 read with 34 I.P.C. and Section 156(3) Cr.P.C., of Nagaram Police Station, East Godavari District. He further contends that after completion of the investigation, respondent No.3 filed charge sheet before the Judicial 2 First Class Magistrate, Razole, East Godavari District vide CC.SR.No.7074/2016. 3. Considering the submission of the learned Assistant Government Pleader and the relief sought with regard to registration of Crime against the respondent Nos.4 to 15 in the light of the order, dated 26.12.2016 in CC.SR.No.7074/2016 on the file of Judicial First Class Magistrate, Razole, East Godavari District, it appears that after completion of investigation, the respondent No.3 filed charge sheet before the concerned court. 4. Under these circumstances, in our considered view, as the relief sought by the petitioner has been achieved already, in our considered view, no further adjudication is required in this Writ Petition. 5. Accordingly, the Writ Petition is dismissed as infructuous. No order as to costs.
