1. The instant petition has been filed for quashing/modification of order dated 28.11.2025 (Annexure P-2) passed by the Court of learned Additional Sessions Judge, Pathankot in CIS No. 263 of 2025 titled as ‘Vijay Kumar vs. Joginder Pal’, vide which the petitioner has been directed to deposit 20% of the amount of compensation/cheque amount within a period of 60 days. 2. Vide judgment of conviction and order on quantum of sentence dated 14.11.2025 passed by learned Judicial Magistrate Ist Class, Pathankot the petitioner was convicted and sentenced to undergo rigorous imprisonment for a period of 02 years for commission of offence punishable under Section 138 of Negotiable Instruments Act and was further directed to pay compensation to the tune of Rs.2,00,000/- (i.e. equivalent to the cheque amount) to the complainant within a period of one month, along with default mechanism. Thereafter, the petitioner preferred an appeal against the said judgment of conviction and order of sentence before the learned Additional Sessions Judge, Pathankot. Learned counsel for the petitioner inter alia contends that the learned lower Appellate Court failed to appreciate the facts in the right perspective and imposed the condition to deposit 20% of the compensation amount and such a condition is illegal, arbitrary and in violation of the law as laid down by the Hon’ble Supreme Court. 4.
