Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondent Nos.1 to 4. 2. This writ petition was filed questioning the action of the respondent Nos.2 to 4 herein in proposing to provide house sites to the weaker sections under Navaratnalu–Pedhalu Andariki Illu Scheme in the petitioners’ lands situated in (1) Sy.No.439/10P to an extent of Ac.2.00 cents, and (2) Sy.No.439/10P to an extent of Ac.2.50 cents, of Gunkalam Village, Vizianagaram Mandal, Vizianagaram District, without issuing any notice, without initiating the proceedings under The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act No.30 of 2013), and without following the due process of law. 3. On the other hand, the learned Assistant Government Pleader, relying upon the counter of the 4th respondent, submits that the subject land was proposed for the housing welfare scheme, but there was an interim direction of this Hon’ble Court dated 09.07.2020. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 5 are directed to deal with the subject land to an extent of Ac.2.00 cents in Sy.No.439/10P and Ac.2.50 cents in Sy.No.439/10P of Gunkalam Village, Vizianagaram Mandal, Vizianagaram District, strictly in accordance with law, if so warranted for any public purpose.
If the petitioners are otherwise found to be in possession of the same, they shall not be

dispossessed from the subject land except by following the due process of law, giving due opportunity of hearing to all the parties concerned including the petitioners, upon verification of the records and the subject land, an appropriate decision shall be taken on its own merits. Any dispossession shall not be made except by following the due process of law. 5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
