4. Case of the prosecution is that on 09.08.2023 at about 07.30 A.M., the sub-Inspector of Police, Chirfuhapalli Police Station along with his staff and mediators apprehended A.1 and A.2 while they were transporting 489.110 Kgs of Ganja. After conducting Panchanama and after seizing contraband, he arrested both A.1 and A.2, who were remanded to judicial custody. During the course of investigation, A.1 and A.2 confessed about the involvement of the \ petitioner-A.7 also.
On the basis of said confession, A.7 was produced on 25.07.2024 on P.T. warrant, who was remanded to judicial custody. Ever since, he is in custody. 5. Learned counsel for the petitioner contends that the petitioner was arrested on 25.07.2024 and ever since he is in judicial custody. He further contends that though the statutory period of 180 days have been completed, the police did not file charge sheet. As such, he requests this Court to enlarge the petitioner/A.7 on bail. 6. On the other hand, the learned Additional Public Prosecutor, on \I instructions, confirms the factum of non-filing of charge sheet though the statutory period of 180 days have been completed. 7. In view of the above facts and circumstances, as the police have not filed charge sheet till the completion of statutory period, this Court is inclined to grant bail to the petitioner/A.7 on following conditions. (a) The petitioner/A.7 is directed to be enlarged on bail on his execution of personal bond for Rs'.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of the learned Metropolitan Sessions Judge, E`.-ri' ~l ct .--

(b) The petitioner/A.7 shall not make any attempt to tamper with the prosecution evidence. He shall make himself available to the Investigating officer as and when required by them to facilitate proper investigation in this Case. (c) The petitioner/A.7 shall scrupulously comply with the above conditions and any infraction of the same will be viewed seriously.
