In the suit instituted by the plaintiffs, an application for grant of temporary injunction was moved, which was allowed by the trial Court. The interim injunction order was violated by the defendants, which led to filing of application under Order XXXIX, Rule 2-A C.P.C., which has been registered as Misc. Case No.1/74 of 2024, which is pending consideration. The sole prayer made in the writ petition is for early disposal of the said application. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Gram Nyayalaya, Bindki, Fatehpur to decide Misc. Case No.1/74 of 2024 (Mohd. Muin Ansari and others vs. Udaybhan Singh and others), in accordance with law, after hearing all affected parties, preferably within a period of four months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
