ORDER:
Criminal Revision Case has been filed challenging the order dated 07.08.2024 in Crl.M.P.No.38 of 2024 in Crime No.125 of 2023 of Sullurpeta Police Station, on the file of the learned Additional Judicial Magistrate of First Class, Sullurpeta, SPSR Nellore District, whereby and whereunder an application filed under Section 457 Cr.P.C. for interim custody of cash of Rs.18,96,382.77/-, which was said to have been forged in suspected accounts under the police proceedings, was dismissed.

2. The petitioner is the de-facto complainant. She was in search of job opportunities for her husband. While pursuing the same, she fell into the trap of online fraudsters. She was deceived and, believing their representations, made 37 transactions into different bank accounts amounting to Rs.69,98,279/- on various dates. Subsequently, on realizing that she had been cheated by online fraudsters, she approached the police, who registered the present case.
3. Heard both. Perused the record.
4. In fact, the de-facto complainant herself paid an amount of Rs.69,98,279/- through her phone on different dates from 27.08.2023 to
14.09.2023. The petitioner has undertaken that, as and when required by the learned Trial Court, she will deposit the said amount and also furnish sufficient surety for the production of the property as and when directed.

Considering the facts and circumstances of the case, this Court is inclined to allow the petition filed in Crl.M.P.No.38 of 2014 in Crime No.125 of 2023 of Sullurpeta Police Station, by setting aside the order dated 07.08.2024 passed by the learned Additional Judicial Magistrate of First Class, Sullurpeta, SPSR Nellore District, on the condition that the petitioner shall furnish sufficient surety to the satisfaction of the learned Additional Judicial Magistrate of First Class, Sullurpeta.

6. In the result, the Criminal Revision Case is allowed, setting aside the
order dated 04.04.2024 in Crl.M.P.No.38 of 2024 in Crime No.125 of 2023 of Sullurpeta Police Station. An amount of Rs.18,96,382.77/- shall be released to the interim custody of the petitioner, subject to the petitioner furnishing sufficient surety to the satisfaction of the learned Additional Judicial Magistrate of First Class, Sullurpeta. There shall be no order as to costs.
As a sequel, interlocutory applications, if any pending, shall stand closed.
