The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the 3rd Respondent in trying to dispossess the petitioner from the land in Sy.No.88/1 of Gownithimmepalli Village, to an extent of Ac.0.40 cents by destroying the cattle shed and tamarind trees and trying to convert the same into house sites and distribute it under the Navaratnalu-Pedalandariki Illu Scheme. 3. The learned counsel for the petitioner submits that the petitioner is in occupation of the subject land. 4. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 3rd respondent submits that the land in Sy.No.88/1 in an extent of Ac.2.20 cents of Gownithimmepalle Village is originally classified as Rasta Poramboke. As per the instructions of the District Collector, Chittoor, the 3rd respondent inspected the Government Lands including the subject land in an extent of Ac.2.20 cents in Sy.No.88/1, which is classified as Rasta Poramboke and the petitioner is having landed property in Sy.No.85/3B in an extent of Ac.0.51 cents just abutting towards western side of the land in Sy.No.88/1. The petitioner is not an encroacher in the subject land. The Government after careful examination of the matter in their public interest decided to de-notify the lands vested with the

Grampanchayat.
Hence, the Government gave notification to de-notify certain poramboke lands, which are vested with the Grampanchayat under sub- section 1 of Section 58 of the Act and as such it ceases to vest in the Grampanchayat and they are vested with the government for providing house sites to the homeless poor under the welfare scheme vide G.O.Ms.No.558, Panchayat Raj and Rural Development (Ptc-II) Department dated 02.03.2020. 5. In view of the above said facts and circumstances, since the land is vacant as per the counter of the 3rd respondent, the respondent Nos.2 to 4 are directed to deal with the subject land strictly in accordance with law, if not already used by now for the above said welfare scheme and if so warranted now, for any public purpose. 6. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
